Tom has been with Milberg since 2003, but his road here has not been the typical one. Tom is the only investigator without a law or law enforcement background. His background is in applications engineering, technical sales, technical marketing, and business and management.

Starting his career as a Metallurgical Engineer, he worked as a steel production mill metallurgist and test laboratory supervisor. From there, Tom became an applications engineer in the heat treating industry and traveled extensively throughout the United States. During this period, he wrote and edited industry standards ranging from fire protection systems to materials specifications for aerospace applications. After the first year in this position, Tom was named Senior Engineer at the firm and was managing his own applications development group.

Tom also worked for an international company as a Sales Engineer covering the USA and Western Europe. The position entailed sales, technical support and marketing as well as serving as the liaison with Research and Development for a specialty alloy manufactured in a confidential company process. Tom developed a new market area and product usage technique.

Tom also worked for an electronics materials company, where he developed the market for a new semiconductor product. Handling coordination of market development, product development, manufacturing inputs, research and development, quality assurance, pricing and international sales, Tom was able to drive a new product from sales of a $300,000 per year market to one hitting $30 million in six years. During that time, he promoted a radical new production technology that cut production costs and increased production efficiency by over 400%. During this time, Tom traveled extensively in North America, Western Europe and the Asia-Pacific regions, and still found time to complete an Executive M.B.A. program from which he graduated with honors. It was also during this time that Tom met Steve Bursey, who recruited him to join Milberg and trained him as an investigator.

At Milberg, Tom coordinated and spearheaded the mutual fund investigation team comprised of eight investigators. Tom developed industry contacts with former high-level employees of a number of firms who provided valuable information. As a result of developing these confidential witnesses, several cases were successfully settled, achieving recoveries for wronged mutual fund holders. A market timing case against Putnam Investments was settled after Tom found former employees who divulged the operation of a market timing department at Putnam.

Tom’s technical background has proven valuable in his investigations. Sometimes a spreadsheet analysis, timeline or other analytical information helps transform allegations in a case to indisputable facts. In a drug development stock fraud case, Tom was able to develop a timeline overlaying a company’s share price with executive officer stock sales and the timing around a Phase III Clinical Trial. Using information obtained from former employees, Tom identified when the supposedly blind test results of these trials (which were negative) first became available to the company.   Tom discovered that company executives knew that the study results showed the presence a key antibody signalling clinical trial failure, among other negative indicators.  This is just one example of how former employees can make a big difference in investor and consumer protection actions.
