Jim is a forensic accountant, whose job description is essentially that of an accounting detective. Jim investigates, for example, whether companies properly accounted for liabilities, correctly booked revenue, improperly used special purpose entities, or fabricated earnings. His contributions are important to all phases Milberg’s litigation practice. Jim collaborates with attorneys to develop case theories, draft accounting sections of complaints, and streamline intensive document reviews by coaching attorneys on how to identify “hot documents,” devising key terms for searches and document classification, and selecting the most effective documents for depositions. In addition, he works with Milberg’s investigators to prepare for and develop accounting related witness interviews, draft document requests and interrogatories, and prepare “ability-to-pay” settlement analyses.

Jim is a Certified Public Accountant and Certified Fraud Examiner with more than 20 years of audit, tax, and forensic accounting experience. Prior to joining Milberg, he was an audit manager for RSM McGladrey, where he conducted and managed a wide range of audit and litigation support engagements for clients in a variety of industries.

In one engagement involving insurance fraud, Jim identified fraudulent documents and calculated damages resulting from the VP of a defrauded insurance company having set up a shell corporation that charged his employer a fee for facilitating international transactions.

Jim has also performed audits of corporate 401(K) and Health Care Plans, successfully represented clients for tax audits resulting in “no change” assessments, and consulted with companies regarding the proper implementation of Generally Accepted Accounting Principles, including revenue recognition and accounting for Variable Interest Entities (FIN 46).  Jim also designed and presented numerous Continuing Professional Education seminars for accountants and auditors.

At Milberg, Jim has worked on securities fraud cases that resulted in total settlements in excess of $5.4 billion. Some of his most notable cases include In re Tyco Int’l Ltd., Securities Litigation, In re Raytheon Company Securities Litigation, In re Biovail Corp. Securities Litigation, and In re Vivendi Universal, S.A. Securities Litigation. In the Tyco litigation, Jim prepared numerous accounting analyses and presentations that were used for complaint allegations, briefs, oral arguments, and depositions. In addition, Jim has assisted attorneys with numerous derivative, False Claims Act (whistleblower) cases and ERISA cases, including In re General Electric Company ERISA Litigation and In re Morgan Stanley ERISA Litigation.

Jim received his Bachelor of Science in Accounting in 1987 from the New York University Stern School of Business. Mr. Brown is a member of the American Institute of Certified Public Accountants and the Association of Certified Fraud Examiners.
